Michael represents business, financial, technology and owner/contractor clients, both in litigation and in non-litigation disputes.

His intellectual property cases have involved patents, copyright, trademarks, and trade secrets. His business cases have involved antitrust law, sales of businesses, manufacturer/distributor/dealer disputes, shareholder and investor disputes and business torts. His financial cases have included disputes involving the Fair Credit Reporting Act, the Fair Debt Collections Practices Act, and consumer contract claims. His construction cases have involved critical path analysis, inefficiency claims involving measured mile analysis, change order disputes, warranty claims, workmanship issues, as well as negotiation of AIA and non-AIA construction and supply contracts.

Relevant Experience

  • Represented a landfill owner in obtaining dismissal of $20 million predatory pricing claim for alleged monopolization of construction demolition debris disposal market, including argument before the Virginia Supreme Court leading to upholding of the dismissal.

  • Represented a regional organization in obtaining a jury defense verdict on an $800,000 road construction claim involving interpretation of plans and specifications.

  • Represented a government contractor in a successful bid protest to the United States Government Accountability Office of a contract with an estimated value in excess of $200 million.

  • Represented a joint venture partner in a case alleging wrongful termination and breach of contract in the California mortgage banking industry that resulted in a million-dollar plus settlement.

  • Represented a trademark and trade secret owner in obtaining an agreement following litigation for defendant to cease using trademark and cease production of product based on owner’s trade secrets.

  • Represented a general contractor in an arbitration claim arising from the new construction of a green-field cement plant that resulted in a multimillion-dollar settlement above the original contract value.

  • Local counsel in over twenty-one (21) cases involving patent, copyright, trademark and antitrust for firms including Brown Raysman, Dewey Ballentine, Frost Brown Todd, Howery, Jones Day, Kennedy Covington, Kilpatrick Stockton, Nixon Peabody, Pillsbury Winthrop Shaw Pittman, Winston & Strawn, and White & Case.

  • Represented non-profit owner of $29 million senior living facility in litigation with municipality over real estate valuation.

  • Represented owner of retail establishment in obtaining an arbitration award for liquidated damages and construction defects after five day evidentiary hearing.

  • Represented a manufacturer in obtaining an arbitration award of over $450,000 against a terminated dealer and successfully defended against a multimillion-dollar Robinson-Patman Act counterclaim.

  • Represented a regional authority in a dispute with the United States Navy concerning liabilities for costs arising from long-term service contracts.

  • Defended a municipality in a claim for over a million dollars arising from the termination of a utility contractor.

  • Represented a limited partner in a case alleging fraud and breach of contract in the operation of a real estate partnership and obtained reversal from the United States Court of Appeals for the Fourth Circuit Court of a grant of summary judgment.

  • Represented businesses and business-related individuals in a variety of fields, including construction, dealer-distributor law, antitrust law, contract disputes, minority shareholder disputes, business torts, trade secret and trademark law.

  • Represented clients in federal and state court, before administrative agencies, in arbitration and mediation and before municipalities in Hampton Roads and across the country.

    Michael graduated from the College of William & Mary in 1993, and graduated from the University of Virginia School of Law in 1996. While at the University of Virginia, Michael served on the Journal of Law & Politics. Michael is particularly involved in the City of Chesapeake where he has lived since moving to Hampton Roads.
